Off the top of my head I'm guessing Siebert's thought process would be protected from disclosure by attorney work product, but, there may be an exception. Also, there are ways around getting this decision into evidence without having to do so through Siebert's testimony. I believe there's a written memo between departments confirming all of this and a good argument is that it should come into evidence. I personally think, based upon the updates I shared in the notes at the end of my original post, that the case will eventually be kicked out of court and dismissed for lack of evidence.
