James Comey's Seashell Indictment Is The Red Line

Today, on April 28, 2026, the federal government indicted James Comey, the former Director of the FBI, for posting a photograph of seashells. Read those words twice. Seashells. Arranged on a North Carolina beach to spell 8647. Two felony counts. Threats against the President of the United States and transmitting a threat in interstate commerce.

The grand jury sat in the Eastern District of North Carolina. The acting Attorney General, Todd Blanche, formerly Donald Trump’s personal criminal defense lawyer, stood at a podium and told America with a straight face an Instagram post of shells on a beach is a federal crime.

If your stomach is not turning, you have stopped paying attention to your own country.

I am a lawyer. I have spent forty years inside courtrooms. I have tried more than seventy jury trials. I have served as a Judge Pro Tem in California. I will tell you plainly: this indictment is not law. This is raw political retribution dressed up in a courthouse suit, and every American who still believes in the Constitution should be on fire about it.

What 8647 Means

Anyone who has worked a day in a restaurant, a bar, or a hotel knows what 86 means. The kitchen is out of an item. The customer gets walked to the door. The phrase has been part of American slang since the nineteen thirties. It is shorthand. It means goodbye.

47 is the number of the current President. Donald Trump is the 47th occupant of the Oval Office.

8647 is a political slogan. It means show this guy the door. Vote him out. You will see the phrase on bumper stickers and protest signs in every blue state in the country. Millions of Americans use it every day.

It is not a hit order. It is not an assassination plot. It is not a threat. Calling it a threat requires a level of dishonesty so brazen the only people who repeat it on television are people who have stopped caring about their own reputations.

The Law This Indictment Cannot Survive

Here is what the United States Supreme Court said in 2023, in a case called Counterman v. Colorado. To prosecute someone for a true threat under the First Amendment, the government has to prove the speaker understood a reasonable listener would interpret the message as a serious expression of intent to commit violence. Recklessness as to such understanding is the constitutional floor. Below the floor, you have protected speech. That is binding constitutional law. That is the standard.

Apply it to seashells on a beach.

James Comey saw shells on the sand. He took a picture. He posted it with the caption “Cool shell formation on my beach walk.” When some people pointed out the numbers carry violent associations in certain corners of the internet, Comey deleted the post and wrote, “I oppose violence of any kind.”

There is no recklessness. There is no intent. There is no threat. There is a man on a beach with a phone, posting a slogan millions of Americans use every day.

The First Amendment exists for exactly this reason. To protect citizens from a government willing to jail them for criticizing the man in the Oval Office. The seashell indictment is the precise nightmare the Founders wrote the Bill of Rights to prevent.

The Receipts

Here is selective prosecution on display. Look at who has used 86 numbers and walked away clean.

Governor Gretchen Whitmer of Michigan appeared on national television in 2020 with a small figurine on the table behind her reading 8645. No indictment. No grand jury. No federal investigation.

Jack Posobiec, a conservative commentator currently in good standing with this administration, posted 8646 during Joe Biden’s presidency. No charges. He recently sat down for a friendly interview with Todd Blanche, the same man now running the Department of Justice.

Donald Trump Junior posted a photograph of a hammer and a pair of men’s underwear on Instagram in 2022, mocking the brutal home invasion attack on Paul Pelosi, an eighty two year old man whose skull was fractured by an assailant wielding the same kind of hammer. No indictment.

Donald Trump himself posts threats against private citizens, federal judges, prosecutors, journalists, and entire foreign populations on his money losing social media platform on a near daily basis. He has openly threatened to wipe out entire countries. He has called for the execution of generals. He has shared images depicting violence against political opponents. No indictment.

The pattern is obvious. Threats get prosecuted in this country only when they point in one direction.

Who Is Bringing This Case

Pay attention to the names.

Lindsey Halligan, another former personal attorney for Donald Trump, brought the first Comey indictment in September of last year. Trump parachuted her into a U.S. Attorney’s office in Virginia for the express purpose of charging his enemies. A federal judge threw the case out and invalidated her appointment as unconstitutional.

Todd Blanche, also a former personal criminal defense attorney for Donald Trump, brought this second indictment. He’s the guy who defended Trump and who did such a good job that his client was found guilty of 34 felonies. He is now serving as acting Attorney General after Trump fired Pam Bondi on April 2 of this year. Trump fired her because she was not aggressive enough in pursuing his political enemies. He then handed the entire Justice Department to his own former defense lawyer.

Read those sentences one more fucking time. The President of the United States fired his Attorney General for refusing to weaponize the Justice Department fast enough. He replaced her with his own personal lawyer. His personal lawyer just indicted the man who once led the FBI for posting shells on a beach.

This is not law enforcement. This is a personal vendetta operation funded by your tax dollars.

And it’s wrong. And I’m pissed. And you should be too.

To Anyone Still Defending This

I am done being polite. I am done pretending there are two reasonable sides to a debate over whether seashells are a federal crime. I am done worrying about whether my word choices upset your delicate fucking ears while you nod along with the dismantling of my country.

If you watched today’s press conference and nodded along, if you shared a Truth Social post celebrating the indictment, if you went on television in a red hat and told your audience an Instagram beach photo is a credible threat against the President of the United States, you are not a patriot. You are a moron.

You are participating in the dismantling of the rule of law. You are participating in the criminalization of political dissent. You are helping build an American police state. It will eventually come for you, your church, your neighbor, your union, your business, your family. The boot does not check membership cards once the precedent is set.

History does not look kindly on the people who cheered as the secret police took their critics away. Read any honest account of authoritarian regression in the last century. The pattern is identical. The justifications are identical. The willing collaborators always insisted at the time they were the reasonable ones.

You are not the reasonable ones. You are the cautionary tale your grandchildren will read about. YOU ARE THE PROBLEM.

So stop. Wake up. Or step out of the way of the rest of us who are trying to save this country.

What You Do Now

The 2026 midterm elections are six months away. Six months. Every House seat is on the ballot. One third of the Senate is on the ballot. Governorships, statehouses, attorneys general, district attorneys, judges.

You vote. You register people who are not registered. You drive your neighbors to the polls. You volunteer at a phone bank. You write checks to candidates who will, on day one of the new Congress, issue subpoenas, hold oversight hearings, defund the political prosecutions, and restore the wall between the White House and the Department of Justice.

You speak. Out loud. At the dinner table. At work. At your kid’s soccer game. You stop being polite about what is happening in this country, because polite silence is exactly what authoritarians count on.

You support James Comey, his attorney Patrick Fitzgerald, and every other American who finds themselves on the wrong end of a politically motivated indictment. You write about it. You post about it. You do not let this story disappear into the next news cycle.

You remember today. April 28, 2026. The day the United States Department of Justice indicted a former Director of the FBI for a photograph of seashells on a beach.

We are still a country worth fighting for. Most Americans know exactly what happened today. Most Americans are watching. Most Americans are taking notes and taking names. Most Americans will vote in November.
