BREAKING: The DOJ Came After Jerome Powell. A Federal Judge Stood Up to the Most Powerful Man in the World. Here Is Why The Judge Got It Right.
Judge Boasberg’s ruling to quash the DOJ subpoenas against Fed Chair Jerome Powell is a masterclass in what it looks like when the judiciary refuses to let the Constitution become a suggestion.
He just threw out grand jury subpoenas the Department of Justice had served on the Federal Reserve Board of Governors. Those subpoenas targeted Fed Chair Jerome Powell. And the judge did not mince words about why they existed in the first place.1
“What the Court must determine is whether the Board is correct in its inference. In other words, what is these subpoenas’ dominant purpose? A mountain of evidence suggests that the dominant purpose is to harass Powell to pressure him to lower rates.” -Judge Boasberg.
Jeanine Pirro, the former Fox News host, U.S. Attorney for the District of Columbia and the prosecutor behind this entire debacle, got her case dismantled line by line by Judge Boasberg, and her response was to rush to a podium and hold what amounted to a political rally disguised as a press conference. She stood in front of cameras and called the judge an “activist,” claimed he left Powell “bathed in immunity,” and spewed legal conclusions so detached from what the ruling said that any first year law student watching would have cringed. It was not the response of a serious federal prosecutor defending a legitimate case; it was the flailing of a political appointee who got exposed, and every attorney in this country who watched it felt the profession get a little smaller.
That’s why I’m writing about this case and ruling right now. I was headed out for a Friday afternoon run but because this breaking news is important, I needed to first get this out to you.
Look, this ruling matters. It matters to you. It matters to your family. It matters to every person in this country who still believes the government should work for the people and not function as a weapon aimed at anyone who refuses to bend the knee to one man. Why Congress Built a Firewall Around the Federal Reserve
Here is something most people never think about until it is too late. Congress designed the Federal Reserve to operate independently from the White House for a reason. Interest rates affect everything in your life, from the mortgage on your house to the price of groceries to whether your employer keeps hiring or starts laying people off. If a president controlled interest rates directly, the temptation to slash them before an election for a short term economic sugar high would be overwhelming. The long term cost, runaway inflation, would land squarely on your shoulders and your kids’ shoulders. Congress saw the danger decades ago and put guardrails in place. The Fed’s governors serve fixed terms and removal requires cause. The president does not get a vote on interest rates. Period.
Donald Trump has never accepted those guardrails. He has said publicly he believes the president should have a say in setting rates. He has called Jerome Powell stupid, a moron, a total loser, and an American disgrace, all because Powell and the Federal Open Market Committee followed the economic data instead of following orders from the Oval Office. More than 100 public statements from Trump and his deputies attacked Powell and demanded lower rates. Think about the weight of the office behind those words. Think about what it means when the most powerful person on the planet turns his full fury on a public servant whose only offense is doing his job.
The Playbook: When Bullying Fails, Send the Prosecutors
When the social media tirades and public insults did not force Powell to cave, the administration shifted tactics. William Pulte, the Director of the Federal Housing Finance Agency, a political appointee with zero law enforcement role, published a letter calling on Congress to investigate Powell over building renovations at the Fed and over Powell’s congressional testimony about those renovations. Pulte hinted the investigation could give the president grounds to remove Powell for cause. Hours later, Trump reposted the letter and demanded Powell resign. The White House press secretary announced the administration was “looking into” the renovations. Trump himself floated bringing a “gross incompetence” lawsuit against Powell and said, “I’d love to fire him. Maybe I still might.”
Then, right on cue, the D.C. U.S. Attorney’s Office opened a grand jury investigation into the same renovations and testimony Pulte had flagged. The office served two subpoenas on the Federal Reserve Board. One demanded records about building renovations. The other sought records related to Powell’s Senate testimony. Keep in mind the renovations had been approved nine years earlier and construction started four years before the subpoenas arrived. The Fed’s own independent Inspector General had already audited the project and raised zero concerns about fraud.
And here is the detail you should let sink in. Shortly after the investigation opened, the president reportedly berated a gathering of U.S. Attorneys for not moving faster to prosecute his opponents. The next day, the subpoenas landed on the Fed’s doorstep.
What Judge Boasberg Saw and Why He Got It Exactly Right
Judge Boasberg applied a well established legal standard supported by nearly every federal circuit court in the country. A grand jury subpoena issued for an improper dominant purpose gets quashed. The judge weighed the evidence on both sides of the scale.
On one side sat an enormous record of the president publicly attacking Powell, demanding rate cuts, threatening to fire him, musing about forcing the Fed’s hand, and openly wanting a replacement who would vote the way Trump wanted. On the other side sat the government’s justification for the subpoenas. And what did the government offer? The renovation went over budget. That was it. Buildings go over budget all the time. The Inspector General had already reviewed the project. Most members of the Senate committee Powell testified before, including members of both parties and the committee’s own chair, said they did not believe Powell committed any crime.
The judge even gave the government an extra chance. He invited prosecutors to submit additional justification privately, the way prosecutors routinely do in other cases. The government declined. It had nothing. No evidence of a crime. No basis for suspicion beyond the fact Jerome Powell refused to do what the president demanded.
Judge Boasberg wrote the ruling with a precision and clarity you rarely see. He noted the obvious pattern this administration has established: Trump publicly names an enemy, calls for prosecution, and prosecutors deliver. James Comey got indicted after Trump demanded it. Letitia James got indicted. Adam Schiff came under investigation. Democratic members of Congress who posted a video encouraging service members to refuse illegal orders were called “traitors” by Trump, and the D.C. U.S. Attorney’s Office tried to indict all six of them. The grand jury in one of those cases refused to go along with it. The judge was right to recognize the pattern for what it is.
This Is About Your Wallet, Your Freedom, and Your Future
You need to understand what is at stake here. If the president gets to weaponize the Justice Department against the head of the Federal Reserve every time he does not like an interest rate decision, the independence of the Fed is gone. Once it is gone, nothing stops any president from juicing the economy right before an election and sticking you with the bill in the form of crushing inflation afterward. Your savings, your retirement, your kids’ college fund, all of it becomes a bargaining chip for political gain.
This is also about something bigger than monetary policy. This is about whether anyone in government gets to do their job honestly without facing criminal investigation as punishment for disagreeing with the president. If that standard holds, no one is safe. Not judges. Not military leaders. Not scientists at federal agencies. Not the career public servants who keep this country running every single day. The message becomes: obey or face the full force of the federal government. And a country where that message is the operating principle is not a democracy anymore.
What You Need to Do Right Now
Judge Boasberg did his part. He stood in the gap and said no. One judge, one ruling, one moment of institutional courage. It will take a lot more moments like this to hold the line.
You need to pay attention. You need to talk about this ruling with your friends and your family, especially the ones who think none of this affects them. You need to share it. You need to contact your representatives and tell them you expect them to defend the independence of the Federal Reserve and the integrity of the Justice Department. You need to vote like your economic future depends on it, because it does. You need to make your voice heard at every school board meeting, every town hall, every ballot box.
The Constitution is not a dusty document behind glass at the National Archives. It is a living promise, a set of rules the founders put in place because they knew a day like this would come. They knew someone would try to turn the presidency into a throne. They built checks and balances for exactly this reason. Those checks only work if people like you demand they be enforced.
Judge Boasberg enforced them this week. Now it is your turn to stand up, speak out, and refuse to let anyone tear apart the country you love. Your kids are watching. Your grandkids will read about this era in their history books. Make sure they read about the generation that fought back.
