DC Attorney General Files Lawsuit to Stop Trump’s Military Occupation
A woman walking home from work in downtown Washington looked up and froze. Soldiers in camouflage stood on the corner with rifles slung across their chests. They were not protecting a war zone abroad. They were stationed in the heart of our nation’s capital. Nearly 2,300 troops sent from seven states have been planted in the city under Donald Trump’s orders. For residents, this does not feel like security. It feels like occupation.
None of this was happening a year ago. Now, there’s drama every single day.
It’s not normal. It’s not OK.
The Lawsuit
DC Attorney General Brian Schwalb has taken the only step left to protect the people he serves. He filed a 52-page lawsuit today to end the deployment and called it what it is, a military occupation that shreds the Constitution. Click here or on the image below to read the complaint.
The Home Rule Act gives the District the right to manage its own affairs. Trump has trampled that law with soldiers patrolling neighborhoods, restaurants, and businesses. By placing these troops under the command of the Defense Department and then deputizing them as law enforcement through the U.S. Marshals Service, Trump has crossed a line that has held for generations. Our country forbids military involvement in local policing for good reason. It is a bedrock protection of our democracy.
As you know, this is not an isolated abuse. On September 2 a federal judge ruled Trump’s use of the National Guard in Los Angeles illegal. That case made clear that the president cannot unilaterally transform the Guard into his personal police force. Now Trump is testing the same tactic in the capital, ignoring that ruling and daring the courts to stop him again. This is more than overreach. It is the deliberate use of military force against American citizens on American soil.
The psychological toll of living under military presence is real. People feel watched, not protected. Families see armed strangers on their streets and wonder who is really in charge, their elected officials or Trump’s appointees. Fear replaces trust. That breakdown damages every relationship between residents and the police who are supposed to serve them.
When soldiers patrol a block, every interaction becomes charged. Neighbors retreat indoors. Business owners watch customers stay away. Restaurant week was extended last month to try to keep doors open during the surge. Even that effort struggled against the chill of an occupied city.
The law is clear. By statute, a president’s emergency deployment cannot last longer than 30 days without Congress. Trump is pretending that limit does not exist. He is also asserting federal command over state militias without bringing them formally into federal service. That is a direct violation of the Constitution. These are not small technicalities. They are fundamental protections against tyranny. If they fall here, they can fall anywhere.
What happens when children grow up thinking soldiers on corners are normal? What happens when young people inherit a government where the president calls out the Guard to silence dissent? These deployments are not temporary disruptions. They plant seeds of distrust that last generations. They tell our kids and grandkids that the Constitution is optional when one man feels threatened. That is not the America we are meant to hand down.
Donald Trump and his administration are treating the District of Columbia like a testing ground for authoritarian rule. Every day the troops remain is another day the rule of law is weakened, another day the bond between citizens and democracy is frayed. Schwalb’s lawsuit is more than a legal challenge. It is a line in the sand. Either we uphold the Constitution now, or we surrender it piece by piece to a man who views the National Guard as his personal security detail.
You should not look away. You should not stay quiet.
